Understand Where Diverters Get Your Product
Before you can stop diversion, you have to know the source. Build an Authorized Reseller Program
An authorized reseller policy is the legal spine of every takedown request you will ever file. Without one, your ability to remove third-party sellers on Amazon or eBay is limited. Your policy should specify who can resell (only signed partners), where they can resell (approved channels only, often excluding Amazon and eBay unless negotiated), how they must handle warranty and customer service, and what quality-control steps they must follow (storage temperature, inspection, expiration handling for consumables).

Every wholesale contract and reseller agreement should reference this policy and require signature. Keep versioned copies. You will need them.
Enforce a Minimum Advertised Price Policy
A MAP policy sets the floor price at which resellers may advertise your product. Structured correctly (as a unilateral policy, not a bilateral agreement), MAP does not violate US antitrust law under the Colgate doctrine.
The mechanics matter. Your MAP policy should be published, apply equally to every reseller, and carry graduated consequences: first violation is a warning, second is a suspension of shipments, third is termination. You cannot negotiate exceptions without weakening the policy for everyone.

Add serialized codes at the manufacturing line if possible. If you retrofit at the 3PL, you lose the ability to trace which production batch a diverted unit came from.
File Test Buys and Trace the Leak
When a diverter appears, place a test buy through a personal account. When the unit arrives, examine the lot code, batch number, or serialized code printed on the packaging. Cross-reference that code against your shipment records. Every wholesale customer received a specific range of lot codes on a specific date. The lot code on the diverted unit tells you exactly which account leaked.
This is the single most powerful tool an emerging brand has. Diverters count on brands being too small or disorganized to trace inventory. When you show up with a lot-code-matched invoice and terminate the account, word travels fast.
Use eBay VeRO and Marketplace Reporting
eBay’s Verified Rights Owner (VeRO) program lets trademark and copyright holders report infringing listings. Once you are enrolled, you can submit Notice of Claimed Infringement (NOCI) forms to remove listings that violate your IP.

VeRO is most effective when combined with an authorized-reseller policy. You cannot remove a listing simply because you dislike the seller, but you can remove listings that misuse your trademarks, images, or product descriptions, or that sell “materially different” units (missing warranty, damaged packaging, expired product).

Build Distribution That Prevents the Problem
Enforcement is expensive. Prevention is cheaper. The brands with the cleanest Amazon and eBay presence are the ones who screen every wholesale account before shipping a single unit.
Vet buyers with a real application: business license, resale certificate, physical retail address (with photos), buyer references, and a signed reseller agreement acknowledging your MAP and channel policies. Reject applications from PO boxes, residential addresses, or businesses less than 12 months old unless they can provide strong references.
